This competition (the “Promotion”) is conducted by Emerson Process Management Australia Pty Limited ABN 99 004 590 005 of 471 Mountain Hwy Bayswater VIC 3153 (together with its successors and assigns, the “Promoter”).

Entry to the Promotion constitutes acceptance of these Terms of Entry. By entering the Promotion, entrants (“Entrants”) accept and acknowledge full responsibility for their decision to participate in the Promotion and to take the Prize if they are the winner.

All Promotion instructions and Prize information published by the Promoter form part of these Terms and Conditions.

Eligibility to Enter

The Promotion is open to all legal residents of Australia aged 18 years or over. The Promoter reserves the right to request any Entrant to provide documentary evidence confirming his/her age. Employees and immediate families of the Promoter and the Promoter’s associated companies and agents and the immediate families of such employees are not eligible to enter the Promotion.

The Promotion commences at 12:00 AEST on Friday 10th February 2018, and ends at 23:59 AEST on Wednesday 14 February 2018 (“Promotion Period”). The Promoter’s clock will be the official time-keeper for the purpose of determining the start and end of the Promotion Period. Late entries which are received by the Promoter outside the Promotion Period will not be accepted.

The Promotion is a game of skill and chance plays no part in determining a winner.

Entrance to the Promotion is via https://contest.fbapp.io/llgxsj and requires entrants to answer the following question (the “Competition Question”) “Tell us in 25 words or less what your favourite Italian Kitchen Product is?”

The Competition Question answers will be judged on 50% creativity and 50% written expression.

The four (4) answers to the Competition Question which is deemed to be both the most creative and most articulate of all valid entries received as judged by the Promoter in its sole discretion will be determined as the winners of the Promotion.

Judges’ decision is final and no correspondence will be entered into.

An Entrant’s entry must not be, without limitation: a) Late;b) Delayed;c) Incomplete;d) Incomprehensible;e) Unlawful;f) Obscene;g) Defamatory;h) Libellous;i) Threatening;j) Pornographic;k) Harassing;l) Hateful;m) Racially or ethnically offensive;n) Capable of encouraging conduct that would be considered a criminal offence;o) Capable of violating any law; and/or p) Capable of giving rise to civil liability.

There is no limit on entries per entrant but each entrant, if deemed a winner, may only be awarded one (1) Prize.

The Prize consists of the opportunity for a minimum of 4 (twenty) winners, where the final number of winners is at the discretion of Digital White Space PTY LTD to increase the number of winners should the opportunity arise. It is a condition of accepting the Prize that the winner for the Prize may be required to sign a legal release as determined by the Promoter in its sole discretion prior to receiving the Prize.

Employees (and their immediate families) of the Promoter, participating retailers, online retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

Promotion starts 12:00 AEST on Friday 10th February 2018, and ends at 23:59 AEST on Wednesday 14 February 2018 (“Promotion Period”).

Each entry must respond to the question posed for the competition that fortnight in either the comments of the post/s or on the Everything and the Kitchen Sink Facebook timeline atwww.facebook.com/insinkeratorau. Alternative methods of entry will not be considered. Multiple entries are not accepted. Each entry must be an original response and all entrants agree that their entries do not contain any material that infringes the rights of anyone else.

The winning comment will be judged by Insinkerator representatives. Judging will be based on the most creative answer in relation to the question.

The judges’ decision is final and no correspondence will be entered into.

Winner will be announced on the Everything and the Kitchen Sink Facebook page on 15/02/15. If any prize is unavailable, the Promoter, at its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.

Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

The Promoter reserves the right to refuse to allow the winner to take part in any or all aspects of the Prize if the Promoter determines, in their absolute discretion, that the winner has through their conduct or other circumstances damaged their reputation and good standing or is otherwise not in a physical or mental condition to be able to safely participate in or accept the Prize. Without limitation, the Promoter may in this instance or any other instance substitute, in its sole discretion, the Prize or a component of the Prize with another prize or component of equal or greater value (but is not under any obligation to do so).

The Prize must be taken on a date or dates specified by the Promoter based on delivery dates, between 10th February 2018 and 14 March 2018.

If a winner is unable to accept delivery of on the date/s required by the Promoter, they will forfeit the Prize.

Unless expressly stated within these Terms of Entry regarding the Prize, all other expenses (including any applicable taxes) are the responsibility of the winner.

No part of the Prize is exchangeable, redeemable for cash or any other prize or transferable. The Prize cannot be sold, scalped, auctioned, raffled, pledged, or promoted as an incentive or reward by any third party as an inducement for any person or other entity to enter into any commercial or other arrangements with that third party.

Notification of Winners

The winners will be contacted by the production company Digital White Space on Wednesday 14th February 2018 via email and direct message on Facebook. It is the responsibility of each Entrant to ensure that they continue to maintain and monitor the correct details for and have access to their email used in association with the Entry.

If a winner is unable to be contacted or does not claim their Prize within 48 hours of being notified in accordance with clause 26 above, the Prize may be forfeited, at the Promoter’s sole discretion. In the event that for any reason a Prize winner does not take the whole or part of a Prize within the time stipulated by the Promoter then that whole or part of the Prize may be forfeited by the Prize winner, at the Promoter’s sole discretion. Neither cash nor other form of compensation will be supplied in lieu of the forfeited whole or part of the Prize.

The Promoter reserves the right to disqualify any Entry or Entrant (including a winning Entry) if that Entry or Entrant is found by the Promoter, in its sole discretion, to have not complied with these Terms of Entry or to have tampered with these Terms of Entry and/or been fraudulent, or otherwise unlawful.

If for any reason this Promotion is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop-out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Promotion, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant regulatory authority), to cancel, terminate, modify or suspend the Promotion.
The Promoter reserves the right to close the Promotion earlier than advertised and the winner will be determined by Judging the Entries received prior to that time.

Publicity and Privacy

By submitting an Entry to the Promotion, Entrants consent to the Promoter and its agents using the Entrant’s name (and any other images or information (including personal information as defined in the Privacy Act 1988 (Cth) (“Personal Information”)) as submitted with the Entry for the purposes of advertising without additional compensation, notification or permission.

The Personal Information that Entrants provide in connection with the Promotion will be collected, stored and used in accordance with the Promoter’s Privacy Policy, located at https://multitap.com.au/privacy-notice/

Limitation of Liability and Release

Entrants agree to release, discharge, indemnify and hold harmless the Promoter, and each of their respective officers, directors, employees, representatives and agents (the “Indemnified Parties”) from and against any claims made by the winner, Entrants, or any other third parties, related in any way to the operation of this Promotion as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Promotion-related activity or participation in this Promotion.

Nothing in these Terms of Entry excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these Terms of Entry would contravene any statute or cause any part of these Terms of Entry to be void. (“Non-Excludable Guarantees”). Subject to the limitations in the preceding sentence, the Indemnified Parties are not responsible for and exclude all liability whether arising in tort (including, without limitation, negligence), contract or otherwise in respect of: (1) incorrect or inaccurate information, whether caused by Entrants, publishing errors, or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (5) any other loss or damage (including, without limitation, loss of opportunity or loss of profits) whether direct, indirect, special or consequential arising in any way out of the Promotion, including (without limitation) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from an Entrant’s participation in the Promotion or receipt or use or misuse of a prize (if determined a winner).


All and any disputes, issues, claims, and causes of action arising out of, or in connection with, the Promotion or a prize awarded shall be governed under the laws of the State of Victoria and subject to the Courts of the State of Victoria.
